The Government of Paraná published on March 22nd decree 4,318, which extends the regulation of the operation of essential services listed in art. 2 of decree 4,317 (March 21st), as a result of the coronavirus crisis. As a result, non-essential services and activities that do not meet the unavoidable needs of the population in the private sector were suspended, in a collaborative effort to confront the public health emergency. We highlight the following articles:
Art. 2 The suspension of non-essential services and activities that do not meet the unavoidable needs of the population shall be considered within the scope of private initiative, with emphasis on non-interference in services and activities considered essential.
Single paragraph. They are considered essential services and activity:
I - water collection, treatment and distribution;
II - medical and hospital care;
III - veterinary assistance;
IV - production, distribution and marketing of medicines for human and veterinary use and odonto-medical-hospital products, including delivery and similar;
V - production, distribution and marketing of food for human and veterinary use, including delivery and similar, although
located on highways;
VI - farming to maintain the supply of inputs and food necessary for the maintenance of animal life;
VII - funeraries;
VIII - collective transportation, including taxi services and privately paid transportation of individual passengers;
IX - chartering for transport of employees of companies and industries whose activity is authorized to operate;
X - transport of health professionals and garbage collection;
XI - collection and treatment of sewage and garbage;
XII - telecommunications;
XIII - storage, use and control of radioactive substances, equipment and nuclear materials;
XIV - data processing linked to essential services;
XV - press;
XVI - private security;
XVII - transport and delivery of cargo in general;
XVIII - postal service and national air mail;
XIX - air traffic control and air navigation;
XX - banking clearing, credit and debit card networks, ATMs and other non-presential services of financial institutions;
XXI - medical and expert activities related to the general social security system and social assistance;
XXII - medical expert activities related to the characterization of the physical, mental, intellectual or sensory impediment of the person with disability, through the integration of multiprofessional and interdisciplinary teams, for the purpose of recognition of rights provided by law, especially in Federal Law No. 13,146 of July 6, 2015 (Statute of the Person with Disability);
XXIII - other medical expert services of the Medical Expert career, indispensable to meet the unavoidable needs of the community;
XXIV - industrial and construction sectors, in general;
XXV - electricity and gas generation, transmission and distribution;
XXVI - public lighting;
XXVII - production, distribution and marketing of fuels and derivatives;
XXVIII - sanitary and phytosanitary surveillance and certifications;
XXIX - prevention, control and eradication of plant pests and animal diseases;
XXX - inspection of food, products and derivatives of animal and vegetable origin;
XXXI - agricultural surveillance;
XXXII - cash transport;
XXXIII - maintenance services, assistance and commercialization of land motor vehicle parts.
It is important to emphasize that the noncompliance with the determinations contained in decree 4.318 may give rise to the violators the penalties contained in the Interministerial Ordinance 5/2020 of the Federal Government, with the possibility of civil, administrative and criminal liability.
In compliance with State Decree 4.230, which deals with measures to prevent and combat the spread of coronavirus, the Secretariat of Sustainable Development and Tourism (SEDEST - former Secretariat of Environment and Water Resources), through Regulation 01/2020 GDP, adopted some measures to prevent the spread of coronavirus. We highlight the following:
The offices of the Instituto da Água e da Terra - IAT (former IAP) will not open to the public for 10 days. The service must be provided by telephone or via e-protocol;
All Conservation Units, which have visitation control, will be closed for an indefinite period of time. Advertising, press and scientific research must be previously scheduled;
In IAT's Forest Nurseries there will be no face-to-face service to the public for an indefinite period. Only internal activities will be maintained. Doubts regarding the requirements approved for the removal of forest seedlings can be resolved via e-mail -firstname.lastname@example.org. The new applications are suspended.
The attendance to the public in the Seed Laboratories was also interrupted and they will maintain only the internal activities.
The Government of the State of Paraná published on March 16th Decree 4,230 that determines measures to confront the public health emergency of international importance due to the coronavirus.
Among these measures, it was determined the suspension of the appeal and defense periods for those interested in administrative proceedings before the Public Administration in the state of Paraná, as well as access to the records of physical proceedings for a period of 30 days, which may be extended.
In addition, the Council of Contributors and Tax Appeals of the State of Paraná will soon issue a ruling regulating the suspension of the trial guidelines.
The Government of Paraná published decrees 4,263, 4,298, 4,230 and 4,231 on March 16 and 19, which deal with and regulate measures to prevent and combat the contagion of the coronavirus. By decree 4298, an emergency situation was declared throughout Paraná territory. In the same act, new actions were presented, aimed at preventing and confronting the pandemic.
Decree 4,263 establishes a border and currency monitoring plan, also as a measure to confront the coronavirus. We highlight the following articles:
Art. 1 Determines the suspension, as of March 20, 2020, of interstate public transportation of passengers from all federal units of the country and the Federal District.
Single paragraph. The suspension provided for in the caput of this Article shall be in force for a period of fourteen days and may be extended or revoked at any time by act of the Chief Executive.
Art. 6 The crew and passengers from foreign vessels that disembark at ports in the State of Paraná may be approached by public agents that make up the action plan provided for in this Decree for monitoring.
Art. 7 Crew and passengers arriving at airports or highways in the State of Paraná may be approached by public agents who put the action plan provided for in this Decree for monitoring and inspection.
In addition, the government published Decree 4301, which amends the wording of Art. 19 of Decree No. 4,230 of March 16, adding the single paragraph as follows:
Single paragraph. In addition to the measures provided for in this Decree, the following activities shall be suspended in the private sector:
I - shopping centers, galleries and similar establishments;
II - gyms or fitness centers. which determines the closure of shopping centers and similar establishments, in addition to gyms and fitness centers. The measure is valid for an indefinite period and is another effort to prevent the spread of the new coronavirus in Paraná.
The State has also issued a letter to representative entities of restaurants, bars and gastronomic centers/polo with the recommendation to close these establishments by midnight. The document guides to the need to intensify the hygiene and cleaning of common areas, in addition to warning the separation between customers of at least one meter away.
