What is EC Merchant and who should it issue?
The merchant deconsolidation is the issuance of the Electronic Certificate (CE), which is done through the registration of the data in the Bill of Lading (BL) in the Federal Revenue Service merchant system.
All those involved in the operation who are recorded in the bill of lading shall issue this documentation. For each bill of lading a different EC numbering is performed, always linking master with his puppy. The objective is to have several deconsolidations, until it reaches the real consignee.
Based on the information provided in this document, the broker may launch the Import Declaration and perform the customs clearance, the container may be redirected to a terminal of choice of the importer and there will be the automatic collection of the additional contribution to the Freight of the Merchant Navy (AFRMM).
When issuing the data at the merchant, all information is filled by international codes, for example the port of saints is represented by BRSSZ, the real currency is represented by the code 790, to include the pallet packaging the code used is 60, a 20 feet container is represented by 22G0.
What are the deadlines and penalties?
The deadlines for issuing this documentation is 48 hours before the ship berths on long routes and 24 hours on exception routes, that is, with a small transit time, such as Montevideo, Panama and Bueno Aires. If the registration is made outside this deadline, the IRS interprets as an omission of information and applies an infraction notice in the amount of R$5,000.00 that can arrive in up to 5 years from the triggering event.
After the merchant CE is issued, the CE number and screens called Basic Data, Charge Item, All Items and Master Puppies are generated. These screens are only presented to certain players in order to ensure the security of the process data.
Merchant EC screens;
Basic Data: On the basic data screen, there is information such as:
Cargo Item: On the cargo item screen, each item must be declared separately, i.e. in FCL cases if there are 3 containers 3 items must be opened. In LCL cases, if there are 7 pallets, they must contain 7 items. In this screen, we have information such as quantity of packages, common mercosul nomenclature (NCM), seal, brand and contramarca.
All Items: On this screen, we have attached all the items released in the CE, making the visualization easier.
Master's Puppies: On the Master's Puppies screen, we can see how many puppies (HBLs) there are for the master and also relevant information, as if there is inconsistency of freight and weight between master and house BL.
In addition to this information, you can see possible blockages in the CE Mercante or even warnings to consult Siscarga.
The information present in the EC must be correct, as it may impact the subsequent steps, otherwise it may generate rework, fines and blockages. For this reason, the accuracy of the data and communication between importer and forwarder is important.
Common user errors and rectifications;
The merchant deconsolidation, is not necessarily performed with the original BL, sometimes, for the short term stipulated by the Federal Revenue, the EC is issued with DRAFT, this is no problem, as long as the information remains the same between draft and original.
Therefore, the bill of lading must be correct, because small details can generate great losses. The most common mistakes are for attention, such as the mode of payment (Prepaid and Collect), Common Nomenclature of Mercosur and even currencies.
In cases of errors, there are 3 opportunities for rectification, but any rectification after the deadline is liable to a fine and blockage, so it is important that the EC has the correct data and that it is checked by all involved.
What about DUIMP?
With the entry of DUIMP (Single Import Declaration), nothing will change in relation to the EC
Merchant, there will be a field in DUIMP requesting the identification of the cargo (EC number), so the customs broker will find the respective data.
